Dear Mr. Armstrong,

As I understand your position, you are seeking a complete dismissal of the charges. If that is the only resolution of this matter that you seek, there is no need to have any discussion regarding plea negotiations. If your position is that you are interested in considering a resolution with a plea of some sort, then I can engage in plea negotiations via email. You have provided much information electronically about your position in the case such that the People understand your arguments and potential defenses. Otherwise, as I understand your position, you are seeking a trial, which has been scheduled, pursuant to your request.

I suggest again that you retain counsel in this matter.

I'll address this to you , Dan , since it is your name on the indictment for 2nd degree assault and because we have known each other personally thru Teller County Republican events for a decade and you should know by now "assault" is not in my character . And you may not of ever thought about it , but about every pair of pants you've seen me in has patches on the right leg where I often rest my lame left leg . I cannot assault anybody unless they are in my personal space -- within short arms length .

I find it downright frightening , and I believe our fellow citizens will too , that you are empowering an irrational , for whatever excuses , 35 year old snowflake's aggressions against elders more than twice his age despite overwhelming evidence .

I decided I don't have time to put together the "Op-ed" or whatever you want to call it to distribute to all the local publications -- and of course be openly available on CoSy as per it's fine print :

I won't repeat here that overwhelming evidence including the witness of my elder guest on whom Matt Walkers in his face rant when he offered some historical context contrary to Mr Walker's absolute zealotry for the marijuana he consumes on the order of hundreds of dollars a month .

I'm going to preface this by mentioning in an alumni description some time ago I commented that the 2 most important things I learned in my 5 years at Culver Military Academy , graduating 55 years ago , class of '63 , was the honor code and how to clean my room . Since then I have I have lived my life with the computer which only tolerates true or false . Thus I have no patience for dishonesty .

Matt Walker's first statement is his first lie . From Matt Walker written statement

I have never in my life "been drinking all day" . It ruins my ability to think the next day at the level I need to to do the programming I do . But beyond that , as these emails show , I was busy finishing clean up for my annual MidSummer party which Mr Walker was about to destroy .

And among the things I was doing that busy morning was final shopping including the purchase of the "moon shine" as a curiosity for my potential guests which Mr Walker feels compelled to note . ( Compare that with Mr Walker's pushing his vaping tool on my elder witness . )

Had I known Mr Walker was making such a claim , I would have requested a breath test on each of us .

I will also be presenting the unusual avoidance by Ms Reed of getting together as sitting down to discuss what actually happened despite 2 court scheduled interval for explicitly that purpose .
And in fact my inability to even get an email response from her unless I include you , indirectly tho it must be in the distribution .

When Ms Reed emailed that she had sufficient information from my emails and the material on CoSy to make a decision whether to go forward to trial that we didn't have to get together , I assumed that we had reached the point where , as a quote I keep around says :

So I was deeply disappointed when , by telephone , not even directly in court , the one time she's been absent , Ms Reed stated your decision to proceed to trial .

Even in the period the Court granted after that for us to meet , it was impossible to even get an email response until I addressed you as directly as I could .

From the fact that I was released on personal recognizance for a $10,000 bond , and beyond that , that the Court most graciously allowed me to travel to Vienna and around Europe to deliver a presentation of CoSy shows that no one believes I am a threat to anybody who needs to be incarcerated 2 years or more .

So it's not about that .

On the , to me inconceivable event that a jury of my fellow Teller County citizens will not agree that Mr Walker has done far , far , far more damage to me for finally taking action ( the only such in a quarter century ) to shove an irrational aggressive irrational young man out of my "personal space" as the phrase goes , and who , as officer Peppley reports :

I noticed the marks had faded somewhat,

by 1600 when I was heading to begin my 2+ days in jail , not to mention the already horrendous unremunerated burden on my time and thought this has been .

Probation is the most conceivable consequence . Is the point to remove my right to vote ? Is it to make me have to give up my 22cal Winchester 52 target rifle from when I was on Culver's JV rifle team ?

Why are state and county funds being used to pursue an upstanding elder citizen against an irrational in your face adult "snowflake" who was "triggered" when his marijuana zealotry was even mildly questioned by elder guest and witness ?

Mr Walker deserved a spanking .

People already know I think there should be a field of highly qualified candidates attracted by your $215,000 salary in the next election .
That won't change .
But certainly if we can't resolve this Monday , when I believe our direct discussion is finally mandatory , I'll spend most of next week making sure the trial is well covered by media .

This is one of the most disruptive and costly events in my life since the power went off when Building 7 fell on 0911 .
