I appealed the ' Failure to Comply ' on the basis of that dismissal and , most particularly , the blatant perjury of the officer ( see  DMV.Appeal990505  ) . I`m not appealing further . I`ve spent about an extra $60 to get this illustration that not even at the administrative appeal level does the State care about the dishonesty of it`s  on-the-street representatives . Boy it will be nice to get to Pathmark and shop , and get to events around town , with much less pain again . I also expect it to be a great asset over the next year and a half  meeting the fellow citizens of my Congressional District ( #8 ) , from 91st Street to Coney Island , in my campaign to be their next , and the first Libertarian ,  Representative . The evolution of the technology is accelerating . And an increasing variety are on the market . After my call to the Pound , I actually was optimistic about having my MB back for the weekend`s Art events . I printed out  Machine Financial History and took along a bill of sale for an earlier machine .Heading off to the subway , the thought that struck me was that I was going to get back my  Freedom to Shop  .The Pound office and operation is not very ' customer friendly ' .There are a couple of chairs by a Coke machine , but they are in the half of the small reception room which is belted off from public use .Much more consequentially , although I see no mention in the  explanation  from the Pound , it turns out they only accept exact change . It sounded from the conversation of the people head of me , that this caused a number of people to have to make more than one trip to the pound .The comment was made that this was to prevent corruption . Seems like virtually all private enterprizes manage to supply the convenience of making small change , and they must be equally concerned that their employees are not stealing from them .My problem was , given the nonexistance of State registration or title , my documentation of the , at the time - informal , and consequently - complex , barter transactions leading to my ownership of the machine , was not accepted . If I weren`t so hyper accurate in my dealings , I probably could have just told the Pound officers that the bill of sale I had for a previous equivalent machine was for this one , and they couldn`t have known otherwise .But , unfortunately , particularly when I pulled out my CoSy Notebook to buttress my case with all this material , it was perceived I was out to ' razzle dazzle ' them . I commented I was just trying to be efficacious .|THU,1022,9:52| Bottom line , the desk officers are requesting notarized record of the transfer from Anthony Pepe . I mentioned that this would have to be constructed from the records I was presenting them .This is an example of the unreality which bureaucracies can induce . They  seized the machine from me with NO assumption that it was not mine . In fact , it has a gold and black sticker with my  Logo  on the back fender , and shows substantial use . Now , I have to coordinate with Anthony to create and get notorized documents which never existed in the first place . I have no expectation that I can resolve these issues by phone and fax to avoid the possibility of another fruitless hike to the Pound .

I never would have guessed the Police Officer`s name was Glenn . Apparently they found some identification number on the motorboard . I think it is probably an engine number , but the engine is a temporary one . I do not believe there is any unique ' VIN ' on any other parts . The $25 tow fee , while I consider it , an extortion given the catch 22 nature of the situation , is small enough that I will see about retrieving my machine today . I feel once this issue is resolved , the City should eat this fee . Today`s problem , is , of course , that the Original Documents required to retrieve the vehicle includes first of all   ' a.) Current Registration Certificate . ' . Also , of course , there is no formal State certified title for the vehicle . In fact , this particular machine was the result of a barter . As I said in a  letter  to Councilwoman Freed 3 years ago  ( so numbers now are  53 and 26  ) :    I`m writing this from the perspective of a 50 year old guy who loves to    get around to the cultural , business and civic events in this city ,    but who has a left ankle shattered in a rock-climbing fall 23 years ago . Since May , 1994 , I have pioneered the use of  a light weight folding ' MotorBoard ' style scooter  to enhance my mobility . The purpose for my letter to my councilwoman was to proactively work for responsible regulation of this new class of personal transport . I have also attempted to bring this matter to your attention by  e-mail  . Clearly my lack of any consequential accidents over these years shows that these vehicles can be ridden in Manhattan ( and the boroughs ) safely . The hundreds if not thousands of youngsters , tourists , fellow greybeards , and even a few bluehairs who have  smiled  ,  ' thumbsUp ' ,  photographed , or enquired about the motorboard - its  cost  , its speed  ,  its mileage , whenever I am riding , evidence that the great majority of New Yorkers consider the existance of this clearly efficient , hi-tek , solution to getting around this town  an enhancement the Quality of Life in their city . I take pride in providing good a  first  example of proper usage - always wearing my helmet with rear view & red rear blinker . I see lots of uses for these vehicles within the Police Department .The Matter at Hand :  The Friday before last ,  September 18  , a New York City patrolman ( ~ 30 , reddish mustache , no ID number visible on either his flak jacket or scooter ) after asking to speak with me while I was stopped at a traffic light , seized my folding Motorboard style ' scooter ' for being unregistered . See notes from Evening of  September 18  below . I tried to explain to the officer the history of my efforts to address the issue of registration of these vehicles , and gave him my folding business  card  with all means of contacting me  . I told him of my  damaged leg  and the difficulties , i.e. pain , it causes me in getting around the city . He was not interested in listening to me or working to solve our mutual concerns . At one point , he in fact wondered why I came down a block where I knew there were likely to be police , as if I should be intimidated by their presence .  Something is wrong if I should . I would have been perfectly happy to receive a ticket for lack of registration , which is , of course , impossible , in order to push for resolution of the regulation limbo . But he was intent on seizure . I apologize for having attempted at that point to ignore him as he was ignoring me . I am waiting for the assignment of my hearing on the not guilty pleas I entered on the issued  tickets  . When all this is resolved , I would like an apology from the young officer for not listening to me .  Extract from CoSy/Current , evening of Motorboard Seizure   ============================: FRI.SEP,980918 :============================|18:5| Heading to : 18-20| 548Bwy 2fl|19:32| At a stop light a block away from the region now closed off around police headquarters and the Federal prison ( see THU.SEP,980910 ) , Police confiscated my  CoSy/MotorBoard  as an " Unregistered Vehicle " . When I perceived that he was going to confisate my machine , mobility , I am chagrined to admit I tried to just take off . Thus I got a " Failure to comply " . The pretext for confiscation is that it is an unregistered vehicle . But , of course , the history of my efforts to get a dialog open to make rules for and register my machine is already on the web . There is no code underwhich to register it . I told the officer that I have a bad leg and the vehicle allows me to get around much more and with much less pain than without it . After taking forever looking thru his handbook of regulation #s , He would not allow me the time to read the summonses before signing them . It turns out I can`t read most of the officer`s writing . Although I plan to represent myself Pro Se , any support in the form of publicity , or legal assistance will be greatly appreciated . Giuliani IS turning this Great City into a Police State .
