SEC. 2. FINDINGS AND PURPOSES. 42USC 12101.
(a) Findings. The Congress finds that
Motorboards fit the definition of Limited Use Vehicles S 121-c. Limited use vehicle. A motor vehicle, other than one registered or capable of being registered pursuant to sections four hundred one or four hundred ten of this chapter, which has a maximum performance speed of not more than forty miles per hour, as defined in section one hundred twenty-two-b of this chapter.But do not fit the definition of Limited Use Motorcycle S 121-b. Limited use motorcycle. A limited use vehicle having only two or three wheels, with a seat or saddle for the operator. A limited use motorcycle having a maximum performance speed, of more than thirty miles per hour but not more than forty miles per hour shall be a class A limited use motorcycle. A limited use motorcycle having a maximum performance speed of more than twenty miles per hour but not more than thirty miles per hour, shall be a class B limited use motorcycle. A limited use motorcycle having a maximum performance speed of not more than twenty miles per hour shall be a class C limited use motorcycle. In terms of performance , Motorboards be either class B or C Limited Use Motorcycles -- if they had a seat or saddle .
A few years ago I rode over to DMV and picked up the forms for registering as a scooter to unilaterally take care of the problem as best I could . Current Motorboards lack a unique serial number for use as a VIN . I couldn`t fill in that blank . This is an easy problem which should be taken care of . S 431. Vehicle identification numbers. 1. Every manufacturer or assem- bler of a vehicle sold in this state shall provide such vehicle with a vehicle identification number and, upon request of the commissioner, shall inform him concerning the location or locations of every vehicle identification number and other identifying numbers on such vehicle. The commissioner may refuse to register or issue a certificate of title for a vehicle made by a manufacturer or assembler who fails to comply with this section. This lack of VIN is one reason I worry that no inventory was taken of my machine ( it has a Kryptonite chain and lock , and a spare 1 liter full fuel bottle , and a full 1 liter tank ) , and I was given no receipt other than the location of the pound .

(i) Class A. Such license shall be valid to operate any motor vehicle or any combination of vehicles except it shall not be valid to operate a motorcycle other than a class B or C limited use motorcycle. (vii) Class M. Notwithstanding any other provision of this chapter, a vehicle which is primarily designed to be propelled by human power shall not be entitled to registration as a limited use vehicle because of the addition of a motor. The commissioner shall determine whether any vehicle is primarily designed to be propelled by human power. Interesting use of word ' entitled ' . By not matching any of the catagories of the regulations , it may well be said that the MotorBoard , derived from the human powered skate board and classic child`s kick scooter , is not 'entitled' to registration . How can one be guilty of failing to register something not entitled to registration ? ARTICLE 17 S 423-a. Enforcement procedures for insuring the retention of vehicle identification numbers on vehicles. 1. Seizure of vehicle. (a) Members of the state police, any local police department or any peace officer acting pursuant to his special duties shall seize and confiscate a motor vehicle or trailer if any original identification number or special identification number is destroyed, removed, altered, defaced or so covered as to be effectually concealed. My reading of the seizure statutes is that they are aimed at impounding stolen or likely stolen vehicles . There was never any question of my ownership of my MotorBoard . ( See 'Operator owns vehicle ' checked 'yes' on Tickets ) Of course , This section does not apply to the MotorBoard because there never was a VIN to be concealed .
Miscellanious related sections : S 125-a. Off-highway motorcycle. Off-highway motorcycle is a motorcy- cle which is not equipped in conformity with the provisions of section three hundred eighty-one of this chapter, would not, if properly equipped, qualify as a limited use motorcycle, and which is manufactured and sold for operation primarily on off-highway trails or in off-highway competitions and only incidentally operated on public highways. S 130-a. Wheelchair. A wheelchair is any manual or electrically driven mobility assistance device, scooter, tricycle or similar device used by a person with a disability as a substitute for walking. An electrically driven mobility assistance device means any wheeled, electrically powered device designed to enable a person with a disability to move from place to place.
