It's your name on my attached indictment for a single shove with one hand of a raging irrational 35 year old out of my face after he had driven off my even more elderly early MidSummer Gathering guest by his aggressive irrationality .  See http://cosy.com/y17/MMM17disaster.html for a thorough description of what happened and associated documentation . I have also attached the last 2 exchanges with Elizabeth Reed who , while I thought the evidence that 35 year old Matt Walker was the aggressor against both my guest and myself , even after we had separated ourselves from him , was overwhelming , and rationality would prevail , you decided to proceed to trial , without ever having a scheduled conference where any outstanding questions could have been answered .

Just how much punishment should a 72 ( 73 in a couple of weeks ) year old who has a fused ankle and therefore cannot possible "attack" a man less than half his age beyond arms length endure for perhaps a bit roughly shoving him out of his face after the extreme irrational provocation documented ? The red marks of my left hand on either side of Matt's neck , NOT his wind pipe , were fading ( altho according to officer Peppley's report , Matt was still raging ) before I even was taken away for more than 2 days in jail .

You know you and I differ on the issue of prohibition in general . I am a very moderate consumer of marijuana , generally in the morning when I dive into work with also coffee and a cigar . I am an example of the millions responsible consumers who are the argument why it should not be criminalized and who are voting across the country to decriminalize it .

Matt consumes an astounding amount of cannabinoid products -- hundreds of dollars a month . I don't know whether and I don't care whether that was the cause of his aggressive irrationality . My guest and witness sent me this note :

You will see in an attached letter that I argue that it is as much Matt's general psychological problems and his too common today "snowflake" "crybully" attitude toward any disagreement which caused his irrational rage and instant screams of "assault . I'm going to have you arrested for assault " after that single , not more than 5 second thrust of his yelling face out of mine .

Pete LaBarre , when I described the event to him at the TCRCC picnic said as a 35 year old , he would have been embarrassed .

I think that's the general attitude of any of our friends , and certainly I will let them know that you deem it worth the cost to the county and state take this debacle to trial . I have absolute faith that a majority of my fellow Teller County peers will share Pete's astonishment that such an attack on elders could end up with the elder being the unambiguously more harmed party , and see an additional 2 years of prison for someone whose last altercation of any sort , never any where one party screamed for the mommy State , was a quarter century ago unjust in the extreme .

Dan , my understanding is that the decision on prosecutions such as this ultimately lies with you .

Do you really feel that further punishment of me is either moral or a justifiable use of judicial funds ?

The DDA had to cancel our conference scheduled for last Wednesday the 11th . It's not been rescheduled yet but a report to the court is due on the 23rd .

See the attached letter . I think most of what I might add would be redundant or speculative .

With respect to any "drugs" : when I was studying visual psychophysics at Northwestern , the brain chemistry people were upstairs . Human brain chemistries are not all the same .

I tested myself as to whether THC made me irrational . That is whether the APL I wrote when too "stoned" to do anything else worked . And worked the next day .

It did and does . Else I would have stopped touching it decades ago .  Furthermore , I think it clear that it has not harmed me physically because many are quite surprised when they learn that I will be 73 in a few weeks .  A friend , Bob Melamede , would have more statistics , etc , on behavioral issues .

As I say in my note to Beth Reed , I'm a no excuses libertarian . But I almost attribute Matt Walker's aggressive silencing of you -- I really wanted ( and still want ) to hear what your direct experiences and bit of history are -- as much to current snowflake culture as to his agitated , for whatever reason  , state . He just goes nuts when anybody questions his world view .

Anyway , don't worry about this debacle . But I do hope to have a chance to get together before you take off .  Nothing changes that I really want to understand , which implies expressing in CoSy , your 4 valued logic .

Your msg sounded like you need a vacation .

I have a business meeting in the Springs Tuesday evening . Otherwise my week is free .

I'd like to convince you that its clear Matt Walker is far more guilty of assault than I am and has already cost Teller and the State , not to mention my 2+ days already spent in jail , indulging what , the new phrase I've head , calls a cry bully .

I plan to be wearing the moccasins I normally wear around here which officer Peppley described as "slippers" in http://cosy.com/y17/Insanity/Case%20Report%20Narrative_annotated.pdf . You have only seen me in my hiking boots , I can't wear regular shoes , which have a large orthotic in my left boot .

I have a permanently extended left ankle since shattering that leg in a climbing accident in 1972 .

Matt walker can run . I can't -- even in my boots . I can't walk without a limp in my moccasins .

Matt can run backward faster than I can move forward .

So how did I even reach him to grab him , admittedly too vigorously , but surely not out of context , and shove him away ?

And what is his hysteria in the 911 call ?

As C......  will testify , we tried to separate ourselves from him after his initial verbal assaults on C.... . But he came after us and belligerently and objectively irrationally claimed that his car ,  parked by the cabin as in the pictures at http://cosy.com/y17/MMM17disaster.html , was being blocked in .

I think its incredible that it takes so many procedural steps before one is able to face their accuser . But I do thank the court for indulging in the extension of time for me to give my Vienna talk now linked on  CoSy .

Ask Dan May what he thinks . Dan and I have differences because I am very much a no excuses libertarian , so the astounding , to me who just has a toke along with coffee and cigar when I'm digging into work , amount of marijuana products Matt consumes is irrelevant whether causative or not .  ( There's also some reason he's apparently not allowed fire arms , too . )

But as I stated on the 2nd , I have faith that no Teller County jury of my peers will consider my actions excessive in light of the provocation , nor Matt's rational , and that the 2 days in jail I have already served is more than sufficient redress for my single action .

I think it is clear that the reality is far different than Mr. Walker represented . He was the aggressor and in an irrational agitated state . This seems most feasible at this point . I think my ability to have all the relevant information open on my website is unusual .  And I think that documentation persuasively shows that Matt Walker was in fact the repeated aggressor and clearly not rational at the time of the incident .  He has consumed and grievously impinged upon not only my time , but diverted Teller and State's attorney's time and resources on a matter which should never have needed to , nor for a rational person would have , invoked these costs .

Clearly both I and C..... stand ready to answer any questions you may have .

I know my case is taking time which could be better spent on truly criminal cases rather than one where all the accuser had to do was be arm's length away to make "assault" physically impossible .

I know our next report to the Court is next Monday , so scheduling any conference is getting tight .

I'm forwarding a note and my reply to C.... about his need to be available for deposition .

My comments with respect to marijuana are in reply to C.....'s sending me the link in his note "An exact description of irrational Matt Walker ..." .

Finally , I am attaching followup exchange between me and C.... getting back to what we would have been discussing had Matt , apparently after emailing the note calling C..... a "buffoon" , not come down into the house and gone into a rant about his car being blocked in when it had nothing within 10 yards of it .

I hope we can settle this simply , rationally and with minimal further cost to any of us .
