| 20210929.0715 | To the Court : I apologize for becoming emotional at the hearing August 12 . But I had been assaulted and utterly incapable of defending myself . And the orders based on perjurious testimony to the Court giving essential dominion over my entire property , even making me unable to secure my own house , was like a second assault . Also , being pro se ,please forgive errors in format or heading . --I have gone thru a hell the last couple of months grossly exacerbated by perjuries of Tony Poland to this court .

I have been unambiguously assaulted , and at 76 with a fused left ankle proved absolutely incapable of defending myself , and have developed a ` floater in my right eye which was struck by the lens knocked into it from my reading glasses I was wearing at the time of the assault . The Polands never had rights to any other tenant for use of or access to outbuildings .
I have had property and mementos of a lifetime pilfered and destroyed , and have , because of court orders based on those perjuries , not even been allowed to secure my house or any outbuildings shared by myself and tenants . I have had trees damaged and cut down with no authorization or reason .
The Polands cut wires in the breaker box in my personal bathroom to another tenants cabin , then lied about the clearly cut wires in order to obtain work replacing the service . Poland,Wire Cutting Timeline

I have lost 1 tenant of 3 tenants because he would not stay as long as the Polands were there . I will lose a second if they are not gone by time certain . I cannot possibly rent to anybody else as long as they remain . The whole property is at risk .

I have been served with papers created claiming $7500 , then $13,000 for a list of work generated the evening of June 16th after this event in the morning triggered this entire sequence .

Tony Poland's list of claimed charges , in and of itself , shows that all the claimed charges were never negotiated , billed , or authorized previously at the time . Many are self serving .
And most egregiously the Polands fail to start off with their building of an authorized structure attached to legacy stable structures , which then thru negligence burned down the entire structures and their own RV & possessions leaving them destitute . I value the loss of that history and the surrounding damage at $13,000 .

But rather than evict them on the spot , I gave them use of my CitiCard to get tools , and other necessities to get back on their feet . I loaned them , then sold them my Isuzu Rodeo for their offered price of $3500 .

I request the court reverse the protection order perjuriously obtained by my assailant , and issue a restraining order allowing me to secure the buildings on the property , including my own home , as a first step towards returning the property to the point where it is possible to conduct business and accept tenants .

I further request a felony warrant be issued against Tony Poland so this attack on a senior citizen can be put before a jury of Teller County peers .

I further request that an eviction order with a date certain be imposed against the Poland family making it clear that they will be removed by Sheriff's deputies that day and any remain property will be considered abandoned .
